Website Display Notice (Squarespace): These Terms and Conditions apply to all visitors, enquiries, trial participants, and enrolled students of Checkmate Karate Academy. By accessing this website, submitting an online form, enrolling, or attending classes, you agree to these Terms.

These Terms and Conditions ("Terms") govern the enrolment, participation, and use of services provided by Checkmate Karate Academy ("the Academy", "we", "us", "our"). By enrolling a student, attending classes, or using our services, you agree to be bound by these Terms.

Important Notice: These Terms are designed to align with Australian Consumer Law (ACL) and general best practices for martial arts academies. They do not replace independent legal advice.

1. DEFINITIONS

  • Student: Any individual enrolled in classes.

  • Parent/Guardian: The legal guardian of a student under 18 years.

  • Membership: Any paid enrolment, casual class, trial, or program offered by the Academy.

  • ACL: Australian Consumer Law under the Competition and Consumer Act 2010 (Cth).

2. ELIGIBILITY & ENROLMENT

2.1 Students must meet the minimum age and program requirements set by the Academy.

2.2 All enrolments must be completed accurately. Providing false or misleading information may result in suspension or cancellation.

2.3 The Academy reserves the right to refuse or terminate enrolment where behaviour poses a risk to safety, welfare, or the reputation of the Academy.

3. HEALTH, SAFETY & FITNESS DISCLAIMER

3.1 Martial arts training involves inherent physical risks, including but not limited to strains, sprains, bruising, fractures, or other injuries.

3.2 By enrolling, students (or parents/guardians) acknowledge and accept these inherent risks.

3.3 Students must disclose any pre-existing medical conditions, injuries, allergies, disabilities, or health concerns prior to participation and update the Academy of any changes.

3.4 Students must not attend classes if unwell, injured, or under the influence of drugs or alcohol.

3.5 The Academy reserves the right to restrict or modify participation for safety reasons.

3.6 First aid will be provided where reasonably required; however, the Academy does not guarantee the availability of medical professionals on-site.

4. CHILD SAFETY & SUPERVISION

4.1 The Academy is committed to child safety and complies with applicable child protection laws in Western Australia.

4.2 Parents/guardians are responsible for supervising children before and after scheduled class times.

4.3 The Academy is not responsible for students outside designated class times.

5. CODE OF CONDUCT

5.1 Students must follow all instructor directions, Academy rules, and safety guidelines.

5.2 Bullying, harassment, discrimination, abusive language, or aggressive behaviour will not be tolerated.

5.3 Repeated breaches may result in suspension or termination without refund (subject to ACL).

6. FEES, PAYMENTS & BILLING

6.1 Fees must be paid in advance unless otherwise agreed in writing.

6.2 Automatic Direct Debit: Where a recurring payment plan is selected, fees shall be automatically deducted on the 1st day of each month (or the next business day if the 1st falls on a public holiday or weekend).

6.3 It is the responsibility of the parent/guardian or student to ensure sufficient funds are available. Failed payments may result in additional administrative fees and/or suspension of training access.

6.4 Fees may include membership, tuition, grading, uniforms, equipment, events, or other services.

6.5 The Academy reserves the right to review and adjust fees with reasonable notice, in accordance with Australian Consumer Law.

6.6 Failure to pay fees may result in suspension or termination of membership.

7. REFUNDS, CANCELLATIONS & MAKE-UP CLASSES

7.1 Australian Consumer Law Notice: Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL).

7.2 You are entitled to a refund, replacement, or remedy if services:

  • Are not provided with due care and skill

  • Are not fit for purpose

  • Are not delivered as agreed

7.3 Membership Cancellation: To cancel a membership or ongoing classes, a written cancellation request must be submitted to the Academy at least fourteen (14) days in advance of the next scheduled billing date.

7.4 Cancellations not received within the required notice period may result in one additional billing cycle being charged.

7.5 Outside ACL guarantees:

  • Membership fees are generally non-refundable

  • Missed classes due to personal reasons, holidays, or illness are not refundable

  • Make-up classes may be offered at the Academy’s discretion and subject to availability

7.6 The Academy may cancel or reschedule classes due to instructor illness, venue issues, public holidays, low attendance, or unforeseen circumstances.

8. SUSPENSION & TERMINATION

8.1 The Academy may suspend or terminate membership for:

  • Safety concerns

  • Serious misconduct

  • Repeated rule breaches

  • Non-payment of fees

8.2 Termination does not affect accrued rights under the ACL.

9. INTELLECTUAL PROPERTY, PHOTOS & VIDEOS

9.1 The Academy may take photographs or video recordings during classes, gradings, or events.

9.2 By enrolling, you grant the Academy a royalty-free, perpetual licence to use such images or videos for:

  • Marketing and advertising

  • Social media and websites

  • Promotional materials

9.3 No personal names will be published without consent.

9.4 If you do not consent to image or video use, you must notify the Academy in writing.

9.5 All training materials, logos, videos, curricula, and branding remain the intellectual property of the Academy and must not be copied, distributed, or used without written permission.

10. UNIFORMS & EQUIPMENT

10.1 Students must wear appropriate uniforms and safety equipment as directed.

10.2 The Academy is not responsible for loss or damage to personal property.

11. LIABILITY & INDEMNITY

11.1 To the extent permitted by law, the Academy excludes liability for personal injury, loss, or damage arising from participation.

11.2 This clause does not exclude rights under the ACL, including liability for death or personal injury caused by negligence where exclusion is not permitted.

11.3 Participants agree to indemnify the Academy against claims arising from breaches of these Terms.

12. PRIVACY & DATA PROTECTION

12.1 Personal information is collected and handled in accordance with the Privacy Act 1988 (Cth).

12.2 Information is used for enrolment, communication, billing, safety, and legal compliance.

12.3 Data will not be sold or shared with third parties except as required by law.

13. CHANGES TO TERMS

13.1 The Academy may update these Terms from time to time.

13.2 Updated Terms will be published on the Academy’s website or provided upon request.

14. GOVERNING LAW

These Terms are governed by the laws of Western Australia, and Australian federal law where applicable.

16. ONLINE ACCEPTANCE & ACKNOWLEDGEMENT

16.1 For online enrolments and website use, acceptance of these Terms may be confirmed by:

  • Ticking an acknowledgement checkbox on a Squarespace form

  • Submitting an enrolment or contact form

  • Proceeding with payment or subscription

16.2 For students under 18 years of age, acceptance must be provided by a parent or legal guardian.

16.3 A copy of these Terms is available on the Academy’s website and upon request.

17. SEVERABILITY

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

18. ENTIRE AGREEMENT

These Terms constitute the entire agreement between the parties regarding participation in Academy services.
